On October 16, 2007, Seoul Semiconductor (SSC) announced that the Korean Patent Court rejected the advancement of Taiwan Advanced Development Optoelectronics Co., Ltd. (AOT) and Korea ITSWELL on October 11, 2007 by the Korean Intellectual Property Tribunal. Application for a ruling. The Korea Intellectual Property Tribunal has rejected the indictment filed by AOT and ITSWELL for the invalidation of patents used by SSC to produce white LEDs.
In 2005, SSC filed an application for the AOT and ITSELL infringement of its white LED patents and filed a preliminary injunction with the Seoul District Court. In response, AOT and ITSELL sued the Korean Intellectual Property Tribunal, claiming that SSC's white LED patent lacked novelty and requested that it be invalid, but was eventually rejected by the referee at the end of 2005. AOT and ITSELL did not accept the appeal from the Korean Patent Court, and the court's ruling on October 11, 2007 clearly established the legality of the SSC white LED patent in Korea. In addition, Taiwan Intellectual Property Rights Office also rejected AOT's indictment against the invalidation of SSC white LED patents on August 3.
